What this settlement is about
Palace Entertainment, operator of the Splish Splash waterpark, set aside $1 million to resolve claims over processing fees tacked onto online ticket purchases, which plaintiffs said violated New York's ticket pricing rules. The class takes in e-ticket buyers from late August 2022 through early March 2024. Each valid claimant's payment scales with the fees they actually paid, and the fund also absorbs administration costs, attorneys' fees, and a class representative award. Claims must be in by 11:59 p.m. ET on August 10, 2026; the opt-out window closed May 26, 2026 and the final approval hearing was held June 25, 2026.
Who is eligible
Customers who bought electronic tickets to the Splish Splash waterpark on Long Island between August 29, 2022 and March 5, 2024 and were charged a processing fee at checkout.
Estimated payout
Proportional share of the $1 million fund based on total processing fees each claimant paid, after deducting fees, costs, and a service award.
No payment amount is ever guaranteed. Pro rata payouts shrink as more valid claims come in, and every payment waits on final court approval and any appeals.
Proof requirements
