What this settlement is about
Ontario agreed to a $59 million settlement of two class actions alleging that chronic understaffing forced repeated lockdowns in provincial jails, confining inmates and immigration detainees to their cells for extended periods in conditions the plaintiffs said breached their Charter rights. The settlement covers people incarcerated between mid-2009 and late 2017 who endured at least 16 staffing-related lockdowns, with most compensation tied to lockdowns after August 2014. Deloitte LLP administers claims through the OntJailStaffLockdowns portal and matches claimants against custody records, so extensive personal documentation is usually unnecessary except for serious harm awards. Claims are due by December 1, 2026.
Who is eligible
People who were inmates in Ontario correctional institutions (Lapple action) or held there as immigration detainees (Dadzie action) between May 30, 2009 and November 27, 2017, excluding a few named facilities, and who lived through at least 16 staffing-related lockdowns during that time.
Estimated payout
Between $2,000 and $68,000 depending on how many qualifying lockdowns a claimant experienced and the harm shown: basic recovery awards of $2,000 to $28,000, differential impact awards of $3,000 to $15,000, and serious harm awards of $20,000 or $40,000, all subject to pro rata adjustment..
No payment amount is ever guaranteed. Pro rata payouts shrink as more valid claims come in, and every payment waits on final court approval and any appeals.
Proof requirements
Partial proof: the base payment does not require documents, but higher payment tiers (such as documented-loss reimbursement) do. You can usually file the simple tier with just the claim form, or attach records to claim more.
