Kroger Prescription Drug Overcharge Settlement (Kirkbride v. Kroger)

Kroger is paying $17 million to end a lawsuit claiming it reported inflated usual-and-customary prescription prices to insurers by ignoring its Rx Savings Club pricing, which pushed up copays for insured pharmacy customers. The case, Kirkbride et al. v. The Kroger Co., sits in the Southern District of Ohio and received preliminary approval in 2026. Payments will be distributed pro rata based on each member's insured out-of-pocket prescription spending. Opt-outs are due October 21, 2026, objections by December 20, 2026, and claims by January 11, 2027.

Customers who used insurance to pay some or all of the cost of prescription drugs at Kroger-family pharmacies from December 9, 2018 onward and were charged copays based on Kroger's reported usual-and-customary prices.
