What this settlement is about

Talcott Resolution, which took over Hartford's life insurance business, agreed to an $11 million settlement in Arbuckle Funding LLC v. Talcott Resolution (S.D.N.Y., Case No. 7:23-cv-07972-CS). The suit claimed the insurer overcharged premium taxes on universal life policies by applying the wrong state's rate or ignoring policyholder moves. Payments go out automatically, so class members do not need to file anything; the August 26, 2026 date is the cutoff to opt out or object. A fairness hearing is set for September 24, 2026.

Who is eligible

Holders of universal life or variable universal life policies issued by Talcott or its Hartford predecessors whose premium tax charges were allegedly miscalculated between 2015 and early 2025, for example because an address change was never reflected in the tax rate or a retaliatory tax was applied incorrectly.
